The Chairs and Members of the Panel

The Act states that Scottish Ministers must appoint a number of people to serve as members of SCAP.

Following open competition, Scottish Ministers have appointed a pool of 8 chairs and 16 members assessed as meeting the required criteria and demonstrating the competences required for appointment. Appointments are for a period of four years with effect from 1 October 2006.

A Panel will comprise a chair, who must be a qualified solicitor, and two members. Selection of a chair and Panel members to address specific appeals will be on a rota basis taking into account availability, geographical proximity and potential conflicts of interest.

The Panel may consider appeals in the circumstances set out in Section 76 of the Act. The panel will consider the appeal in line with the appeal procedures set out in the SCAP Rules of Procedure.

The Panel is independent of Ministers but is accountable to them. The chairs and members of the panel must abide by the principles of collective responsibility and are expected to conduct themselves in a manner befitting public office. They must also identify in a register of members’ interests certain interests to ensure that no conflicts arise between their outside interests and their appointment or any particular case.
